Required Information for a Valid DMCA Notice

2. Identification of the copyrighted work. Identification of the copyrighted work or works you claim have been infringed. If multiple works are covered by a single notification, a representative list of such works is acceptable.

3. Identification of the infringing material. Identification of the material that you claim is infringing and that is to be removed or access to which is to be disabled, with enough detail for us to locate the material on our services.

4. Contact information. Your name, address, telephone number, and email address so that we may contact you regarding your complaint.

5. Good faith statement. A statement that you have a good faith belief that the use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.

6. Accuracy statement. A statement made under penalty of perjury that the information in the notification is accurate, and that you are the copyright owner or are authorised to act on behalf of the copyright owner.

Our Response to DMCA Notices

Upon receipt of a valid and complete DMCA Notice, Telvexa will act expeditiously to:

Remove or disable access to the allegedly infringing content.

Notify the affected user that the content has been removed or access has been disabled.

Provide the user with an opportunity to submit a counter-notification if applicable.

We reserve the right to determine the validity of a DMCA Notice before taking any action. Notices that are incomplete, inaccurate, or do not meet the statutory requirements described above may not be processed.


Counter-Notification Procedure

If you believe that material you posted was removed or access to it was disabled as a result of a mistake or misidentification, you may file a counter-notification with our designated agent. Your counter-notification must include the following.

Required Information for a Counter-Notification

1. Physical or electronic signature. Your physical or electronic signature.

2. Identification of removed material. Identification of the material that has been removed or disabled and the location where the material appeared before it was removed or disabled.

3. Statement under penalty of perjury. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.

4. Contact information. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of an appropriate judicial body and that you will accept service of process from the person who submitted the original DMCA Notice.

Upon receipt of a valid counter-notification, Telvexa will forward a copy to the original complainant. Unless the complainant files a court action within the required statutory period, the removed material may be restored or access to it re-enabled at our sole discretion.


Repeat Infringers

Telvexa maintains a policy of terminating, in appropriate circumstances, the accounts of users who are determined to be repeat infringers. A repeat infringer is a user who has been notified of infringing activity more than once and has continued to infringe, or whose account has been the subject of more than one valid DMCA takedown notice.

Telvexa reserves the right to make the final determination regarding whether a user qualifies as a repeat infringer under this policy.


Misrepresentation

Please be aware that knowingly and materially misrepresenting that content is infringing your copyright, or that content was removed or disabled by mistake or misidentification, may expose you to liability under applicable law. Before submitting a DMCA Notice or counter-notification, we strongly encourage you to seek independent legal advice if you are uncertain about your rights.


Modifications to This Policy

Telvexa reserves the right to modify this DMCA Policy at any time. Changes will be reflected by updating the "Last Updated" date at the top of this page. Continued use of our services following any modifications constitutes your acceptance of the updated policy.
